Terms of Service

These Terms of Service ("Terms") govern your access to and use of services provided by AIC INTELLIGENCE, LLC ("AIC", "we"), a Delaware (USA) limited liability company, via aic-intelligence.com. By purchasing a report or otherwise using the service, you agree to these Terms.

1. The Service

AIC delivers Market Discovery Reports: structured analyses of local SMB niches, including behavioral clusters, dominant hashtags, and decision-to-product scoring, derived from public Instagram and Google Maps data. Tiers, prices, and inclusions are described on the pricing page.

2. Eligibility

You must be at least 18 years old and authorized to bind your organization. The service is intended for B2B use.

3. License and acceptable use

Each purchased report is licensed to you (or your agency) for internal B2B prospecting and market research, including:

• Use within your organization or for your direct clients (in a white-label engagement)
• Inclusion in client deliverables you produce, with reasonable attribution if requested
• Internal storage and reference

Without a Continuous subscription, you may not:

• Resell, redistribute, or sublicense the data as a standalone product
• Use the data for spam, harassment, or any purpose that violates the rights of the businesses included
• Reverse-engineer, scrape, or automate access beyond the rate limits indicated in the API documentation

3.1 Monitoring and license enforcement

Each delivered report carries an embedded license fingerprint tied to your buyer email and contains a small number of monitored records (proprietary control identifiers, undisclosed and unique per report) used to detect unauthorized redistribution. Outreach activity to these records — including direct messages, emails, calls, and any other channel — is logged.

If we detect such activity originating from anyone other than you (or a party explicitly licensed by you in writing), this constitutes prima facie evidence that the report has been redistributed in violation of this license. Consequences include, cumulatively:

• Immediate termination of all active licenses and any Continuous subscription, without refund
• A liquidated damages obligation of US$ 5 per record contained in the redistributed report, payable on demand
• Right to pursue further damages, attorneys' fees, and equitable relief (including injunction) under applicable law

By purchasing a report, you acknowledge that this monitoring is reasonable, proportionate to the harm caused by leak/resale, and a material consideration of the license fee.

4. Payment

Reports are paid up-front via Stripe in US Dollars. Continuous subscriptions renew automatically each month until cancelled. You can cancel at any time from your account or by emailing support; cancellation stops future renewals but does not refund the current period.

5. Refunds

We offer a 14-day refund on any single report if no cluster in the report is usable for your purpose. Email support@aic-intelligence.com within 14 days of delivery with a brief explanation. Continuous subscriptions are refundable on a pro-rata basis only.

6. Disclaimers

Reports are delivered on a best-effort, as-is basis. We curate data from public sources that change frequently and we do not guarantee:

• Completeness of any market — coverage varies by niche, city, and country
• Accuracy of any individual business listing — Instagram and Google Maps data evolves
• Specific commercial results from using the data

For markets without sufficient existing coverage, we capture on demand; the ETA shown at checkout is our good-faith estimate, not a contractual deadline.

7. Limitation of liability

To the maximum extent permitted by law, AIC's aggregate liability arising out of or related to the service shall not exceed the amount you paid in the twelve (12) months preceding the event giving rise to the claim. AIC is not liable for indirect, incidental, or consequential damages.

8. Compliance and outreach by you

Reports include contact information that businesses have voluntarily published. Your use of that information must comply with all applicable laws (CAN-SPAM, TCPA, GDPR, LGPD, CCPA, etc.). You are solely responsible for obtaining any required consents before contacting any business in a report.

9. Intellectual property

The structure, methodology, branding, and software underlying the service are proprietary to AIC. We grant you a non-exclusive, non-transferable license to use the report content as described in Section 3. All other rights are reserved.

10. Termination

We may suspend or terminate your access if you breach these Terms, abuse the service, or attempt to bypass technical safeguards. You may terminate at any time by ceasing use; outstanding obligations survive termination.

11. Modifications

We may update these Terms. Material changes will be notified by email and shown on this page. Continued use after the effective date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in English, in Wilmington, Delaware. Either party may bring individual claims in small-claims court.
